On this page I have posted some emails that have come in from people enquiring about Tonga, living here, and land or business offers. My responses are directly after. In both emails I have edited out names, email addresses and particulars which might not be germane or may be personal. I have also corrected most of the spelling and wording since these responses are rapid fire and not intended for public review. This is a form of Q & A in a more expressive way.
Subject: waterfront lots at Lafi Moetala $3.300. *** Never tell a real estate person their prices are too low. How to explain the pricing is probably as simple as supply and demand, but Tonga is never just that simple. Prices are lower on most everything, probably mostly due to the fact that Tonga is not known in the world---yet. Not a lot of people here and not a lot of people telling others about the place. But, like any good thing, it will be the talk of the globe one day and just like Tahiti, Fiji and Vanuatu, this place will probably see its share of activity with commensurate pricing. The government seems content with letting the secret out quietly and some say they have a plan for closing the door when the demand is met. Only 5% of Tongan land can be held by foreigners, so that number may be coming up soon. Believe me, prices were a lot lower before I arrived here 5 years ago. I reinvented the broker business here and have the first, and maybe the only, real estate broker license that was created for me a few years back. Accidentally I stumbled into the business while selling a bar I owned here in Vava’u on Ebay. It was unheard of at the time to sell something like that and even the Internet was virtually unknown. The Internet speed was 14.4 and I had to take all day to send some pictures to my brother in America to post on the webs. In short order I managed to get the phone company to come up with a faster speed and a lease line, which led to my opening the first Internet café in Vava’u. Imagine being the first to have these two businesses in any country, and that was just 5 years ago. So prices have gone up and are now “high”, relative to what they used to be, like 300% higher, cheap as they are now. The next lots won’t be on the sea and are supposed to $5,500. As things get closer to the max out, I am not sure we will even have a warning. This would result in shut down before a ramp up of prices. Only in Tonga would this scenario likely happen. In the circumstance where no more Tongan land might be offered, that which is foreigner held would escalate dramatically. Unfortunately, that would leave the Tongan out of the second wave. To mitigate that situation, the agreements on the lots require that 1.5% of the resale price of every house built on the lots is paid back to the Tongan landholders. As well, any rental income from the houses built there are shared in some very small portion with the landholders. This may be seen as a little deterrent to buying a lot, but the plan provides a landholder a future income from his land that is inflation tagged. These two factors are annoying to some who don’t see the need to share the wealth in this most limited way with these native landholders. Prior to the influence of foreigners, these people have lived off their land by growing crops and now, thanks to thoughtful concepts, they are earning in a way that benefits both, the “Investor” and the landholder. The concept even sorts out the kinds of folks interested in living in Tonga. Anyone who sees this program in a positive light as being a part of their contribution to this country’s populace is deserving and encouraged to live here. The people of these developments are the most welcome people to Tonga. The lots are available for 99 years under an “investment” agreement, which I have outlined the negative aspects above. There is no freehold here in Tonga. Funny how a thing can be seen cheap by some and expensive by others. Present value of money and other considerations factor into these things as well. For what it is worth, have one lone lot being offered soon for $18,000 USD, no payments. It has water and power near it too. RB Below is how a typical email of Q & A might go. Is a survey of the land on file? What about aerial photos? YES, SURVEYED AND HAS DEED. I WILL LOOK FOR AERIAL PHOTOS AND SEND IN NEXT EMAIL LET ME KNOW IF YOU DON’T GET ANYTHING SINCE ATTACHMENTS GET LOST SOMETIMES. We are considering a trip to visit the property, although is the "jungle" too dense to walk through? YES, BUT WE COULD BRING OUT A LOCAL FELLOW TO HACK A TRAIL IN THERE. OR YOU CAN GO DOWN THE ISLAND TO WHERE IT IS EASIER TO ACCESS THE OCEAN SIDE. I HAVE PHOTOS OF BOTH SIDES, BUT NOT FROM THIS PARTICULAR LAND TO THE OCEAN. I EXPECT IT IS REPRESENTATIVE SINCE THE COASTLINE IS ABOUT THE SAME EVERYWHERE THERE. YOU CAN GET TO THE CALM SIDE WHERE THE BEACH IS EASILY. THAT IS THE WAY YOU WOULD ARRIVE EVEN AFTER A CLEARING WAS MADE. CLEARING IS CHEAP BECAUSE LABOUR IS CHEAP. What type of deposit is required? THEY SAID THEY WOULD TAKE $10,000 USD TO HOLD IT. I read an article that stated the actual owners have rights to the structures that are built on their land by the those leasing the property; is this true? NO, NOT TRUE. BUT I AM INTERESTED IN THAT ARTICLE. CAN YOU SEND ME THE URL OR WEB ADDRESS? I TRY TO KEEP UP ON ALL THE STUFF ABOUT LAND AND THERE ARE A GREAT DEAL OF MISUNDERSTANDINGS ON THE SUBJECT. Is it preferable to finance a project for development in Tonga or in the U.S.? YOU CAN GET FINANCING HERE, BUT IT IS EXPENSIVE AND NOT EASY. 12% IS THE BEST INTEREST RATE. Are there architect/contractors available? YES… We do know architects who specialize in building on tropical locations that we can consult with outside of Tonga, but not sure how this is viewed by the Tongan gov't. THEY ARE FINE WITH IT. NO PROBLEM. I've also read about the Business License Act and tourism industry incentives, it seems that this process is not as complicated as some other places, although I have not found extensive information yet. NOT A BIG PROBLEM. YOU QUALIFY FOR A BUSINESS VISA BY INVESTING HERE. LEASING THIS PIECE WITH A BUSINESS PLAN WOULD BE REQUIRED. THE LICENSES FOR OPERATION ARE BEING PROMOTED BY THE KINGDOM SINCE THEY NEED INVESTMENT CAPITAL HERE. THIS IS THE GROUND FLOOR AND THEY ARE CHANGING THE LAND LAWS TO ATTRACT THIS KIND OF INVESTMENT. THIS PARTICULAR LAND MAY QUALIFY FOR THE NEWEST CHANGE WITH POSSIBLE LEASES UP TO 999 YEARS. THIS WILL DRIVE THE LAND PRICES THROUGH THE ROOF AND THIS PROPERTY, IF WE COULD MANAGE THIS KIND OF LEASE WOULD BE WORTH DOUBLE TO TRIPLE THE PRICE. THIS IS THE FIRST SHOT AT WHAT AMOUNTS TO ‘FREEHOLD”. FREEHOLD, OR OWNERSHIP, WHICH 999 YEARS OR EVEN 99 YEARS IS AKIN TO OWNERSHIP, A NEW CONCEPT HERE. THIS WAS ANNOUNCED JUST YESTERDAY OFFICIALLY BY THE PRIME MINISTER. I MET WITH HIM DIRECTLY ABOUT IT. STILL MANY UNCERTAINTIES, BUT A HUGE STEP IN THE DIRECTION OF CREATING LAND VALUES COMPARABLE WITH FIJI AND FRENCH POLYNESIA. How affected is the Vava'u area by some of the political unrest we're hearing about? NOTHING UP HERE GOING ON. I HAVE WRITTEN MY OWN RENDITION OF THE EVENT AFTER DISCUSSIONS WITH GOVERNMENT PEOPLE. Good morning *****, Yes, we have a club of sorts and like kids on the first day of school, anxious to make new friends. Americans rate high out here, in spite of our unpopular political stuff back there in DC. Regarding the article… there must be more where the …. Is, for it refers to both cases and only one is referenced there. The owner of the tax allotment is the Tongan. He leases the land to you through a government land lease, and then it can get more complicated, depending on what other kind of extended agreements are in place. The other agreement Hogan might be referring to is a Tenancy Agreement, which is an agreement for other than land, but rather for that which is built upon the land. In this case, the trade off of owning your own buildings is for an extended period for the use of the land beyond that of the limits of a government lease (the only legal lease) which results in the hard to swallow, but inert, renting of your own buildings from the Tongan landholder. The terms of this agreement are such that it is virtually a lease and with the same rights to privacy and control over everything you build or removed there. There are other options today, as of last week, for extended terms on certain land parcels; up 999 years in special cases. A step in the direction of extending the limited terms afforded until recently. Too much to get into now, but things are becoming more conducive to investment, which was the intention of the new changes. The land laws are like anything appearing complex, not really complicated once you know it, but getting to know it is akin to getting a law degree. I have spent more time studying land law here than any in the land department or any lawyer… I know that because they ask me what the laws are. The situation here is a bit odd since the country adopted English law many years ago, and they are still very “foreign” to Tonga and may have not yet been fully read or studied by most of the laid back Tongan leaders. English is the business and official language here, but it is their second language, accounting for their own difficulties in interpretation. The highest judge is British and paid by England to prevail over the law here. If that doesn’t add to the irony. As for Umuna, there is a small deposit on the way here from a couple from Georgia. They are flying out in a few days. They actually put up deposits on two places now and talking about a third. You never know what is next here. We shall see what happens soon. Umuna is a nice piece and I should think they would take it. Every bit of the land out here is going up in value fast, so they may not care what they get if it can be turned later for a profit. Very American I must say, and it does work. Odd how many Europeans don’t think of a resell scenario. Keep in touch and an eye of the web. NO, REFUNDING A DEPOSIT GIVEN TO A NATIVE IS NEAR IMPOSSIBLE, SO I DON’T EVER DARE TAKE THE CHANCE. How long can they hold the property? DEPENDS ON THE SITUATION AND THE DEPOSIT. IT COULD BE IN THE OFFER. I did receive the attachment of the photos! Makes me wish I could jump on a plane right now; unfortunately, my schedule will not permit that right now. IN TIME. Any suggestions for routes or airlines flying from the states. It seems that most flights have several stops from LAX through various locations (e.g. Fiji, Amer. Samoa, NZ, or Aus.)? YES, LAX IS THE HUB FOR THE SOUTH PACIFIC FROM THE STATES. SUGGESTIONS; TRY CALLING FIJI TRAVEL 1 800 500 3454. THEN GO TO AIR PACIFIC OR AIR NEW ZEALAND AND FOR THE BEST FARES, WE HAVE FOUND “CHEAP TICKETS” WHEN YOU ARE FLEXIBLE WITH DATES OF DEPARTURE AND RETURN. THERE IS A BOX THERE FOR THAT KIND OF OFFER. MY 21 YEAR OLD DAUGHTER IS COMING OUT ON AIR NEW ZEALAND AT $1600 TOTAL FARE, INCLUDES ALL TAX, ETC, BUT SHE TURNED DOWN A CHEAPER FARE OF JUST $1100 ON AIR PACIFIC (DAD IS PAYING) OPTING FOR A SHORTER LAY OVER WITH AIR NZ.
